Legal services in Montenegro		01.09.2010 12:00 Preparing of the new Law on Execution Procedure of Montenegro The Ministry of Justice of Montenegro under its authority is preparing changes of the Law on Executive Procedure. Draft of the Law of Executive Procedure (hereinafter “Draft”) is published on the Website of Ministry of Justice of Montenegro, which indicated that the executive procedure will be covered with many essential reforms, that will contribute the more efficiency of the same. It is important to stress that with adoption of new Law of Executive Procedure, a large part of authority will be assigned to executors, who will have to fulfill the terms proscribed by the Law of Executive Procedure for that function, which indicates importance of the function that will performed. According to the “Draft”, we want to point out to several important items which entities should take into consideration during the organization of their business, in order to collect their claims more successfully, after adoption of the new Law of Executive Procedure. Namely, the Law of Executive Procedure of Montenegro in force prescribes that the invoice is authentic document, but above mentioned “Draft” stipulates that the invoice have to be followed by delivery note or other evidence of issued services or delivered goods. Also, this draft of the law introduces new acts that will be considered as authentic documents, as it follows : the mortgage contract and pledge statement, and notary act which is enforceable, and foreign notary act if it contains all elements that convenient for execution. Draft of the above said Law contains efficiency innovation, namely the motion of execution could be based on the foreign authentic document (invoice etc.) if there are factual, unless it is not diplomatic or judicial reciprocity. Taking into consideration this innovation, the debt collection for the foreigner and foreign entities will be simpler, because according to the Montenegrin legislation in force foreigner or foreign entities can submit only the lawsuit for debt collection based on the foreign documents that procedure is much longer than executive procedure. The adoption of the new Law of Executive Procedure is expected until the end of the 2010. (Source: Ministry of Justice of Montenegro) 01.09.2010 12:00 Pripremanje novog Zakona o izvršnom postupku Crne Gore. Ministarstvo pravde Crne Gore, u okviru svojih ingerencija priprema novi Zakon o izvršnom postupku Crne Gore. Na sajtu Ministarstva pravde Crne Gore objavljena je Radna verzija Zakona o izvršnom postupku (u daljem tekstu „Radna verzija zakona“), iz čije sadržine se može uočiti da izvršnom postupku predstoje korijenite reforme, koje će doprinijeti veoma značajnoj efikasnosti istog. Bitno je napomenuti da će se donošenjem novog Zakona o izvršnom postupku, veliki dio nadležnosti ustupiti izvršiteljima, koji će za tu funkciju morati ispunjavati zakonom propisane uslove, što ukazuje na značaj funkcije koju će obavljati. Iz Radne verzije zakona, izdvojićemo nekoliko bitnih novina koje predstoje, a koje bi privredni ali i drugi subjekti već trebali imati u vidu prilikom organizovanja poslovanja, kako bi nakon donošenja novog Zakona o izvršnom postupku bili u mogućnosti efikasno naplatiti svoja potraživanja. Naime, Zakon o izvršnom postupku koji je na pravnoj snazi, propisuje da je faktura vjerodostojna isprava, dok Radna verzija zakona predvidja da fakturu prati otpremnica ili drugi dokaz o izvršenoj usluzi domaćeg ili stranog pravnog lica. Prednje ukazuje da bi privredni i drugi subjekti već trebali uskladiti svoje poslovanje u ovom dijelu, i praktikovati da svaku izdatu fakturu prati dokaz o izvršenoj usluzi. Takodje, ova Radna verzija zakona uvodi dva nova akta, koja će se smatrati vjerodostojnom ispravom, i to ugovor o hipoteci i založna izjava, kao i notarski akt koji predstavlja izvršni naslov, te strani notartski akt ako sadrži sve elemente pogodne za izvršenje. Veoma značajna novina koja se može uočiti u Radnoj verziji zakona, jeste da će se prijedlog za izvršenje saznivati i na stranoj vjerodostojnoj ispravi (fakturi i sl.) pod uslovom postojanja reciprociteta koji može biti i faktiči, ukoliko nije diplomatski ili zakonski. Shodno prednjem, naplata potraživanja stranih lica bi se u velikoj mjeri olakšala, jer u skladu sa trenutnim zakonodavstvom strana lica mogu istaći zahtjeve za naplatu svojih potraživanja po osnovu vjerodostojnih isprava samo u parnici, koji postupak mnogo duže traje od izvršnog. Usvajanje novog Zakona o izvršnom postupku očekuje se do kraja 2010. godine. (Izvor: Ministarstvo pravde Crne Gore) 25.08.2010 15:00 Ministry of Labor and Social Welfare submitted a report on the work of Labor Inspection in the six coastal municipalities for the period from 15.06. 2010 until 15.08.2010 This year like as previous years the Ministry of Labor and Social Welfare, before tourist season, adopted the Action Plan for carrying out the inspection surveillance in the part of the implementation of regulations governing labor relations, employment and safety at work, particularly in the part of the implementation of measures to: - Employees receive regular salary and allowance;- Employers provide to the employees adequate protection at work;- The employer conducts training and training of employees for safe work;- Employers provide Specialist medical review of employees who work in jobs with high risk; as well as- Control the working conditions and environmental regulations on risk assessment in accordance with the Law on Protection at Work. In the period from 15.06.2010 until 15.08.2010 was performed inspection at 3593 subjects and found 3091 irregularities, mostly related to the work of foreigners who do not poses neither Working or Resident permit. In cases of non compliance with regulations in terms of employment of residents and nonresidents, Labor Inspection temporarily prohibits work until employer eliminate irregularities, in other words until regulating the labor and legal status of employees. Also, Labor Inspectors are in addition to cases of illegal work, emphasized the prohibition of work and part of safety when it is determined that threatened the health and lives of employees, or if the employer fails to comply with the decision of the inspection. In the period from 15.06.2010 until 15.08.2010, Labor Inspection has issued 128 interim measures of prohibition, 1346 fines in total amount of 222,090.00 €, and for 1158 were ordered the removal of irregularities subjects, while the default of pointing passed 276 resolutions and the execution thereof in progress. Above mentioned results were contributed by cooperation of employees with the Labor Inspection. The largest number of injuries is related to violations of the Law on employment and work of foreigners, which is demonstrated by the fact that more than 600 foreigners were found without Work or Resident permit, however it can be concluded that the same number should not concern us considering the official data Employment Agency of Montenegro, that June were issued 2094 Work permits, and in the period from 01.01. 2010 until 09.08.2010 were issued 9183 work permits. (Source: Government of Montenegro) 25.08.2010 15:00 Ministarstvo rada i socijalnog staranja predalo izvještaj o radu Inspekcije rada u šest primorskih opština za period od 15.06. 2010. Godine – 15.08.2010. godine Ove kao i predhodnih godina Ministarstvo rada i socijalnog staranja, prije početka turističke sezone, donijelo je Akcioni plan vršenja inspekcijskog nadzora u dijelu primjene propisa kojima su uređeni radni odnosi, zapošljavanje i zaštita na radu, tačnije u dijelu sprovođenja mjera da: Zaposleni ostvare pravo na zakonit radni odnos; Zaposleni redovno primaju zaradu i regres; Poslodavac obezbjedi zaposlenima odgovarajuću zaštitu na radu; Poslodavac sprovede obuku i osposobljavanje zaposlenih za bezbjedan rad; Poslodavac obezbjedi specijalistički pregled zaposlenih koji rade na radnim mjestima sa povećanim rizikom; kao i Kontrola uslova radne sredine i akata o procjeni rizika koji reguliše Zakon o zaštiti na radu. U periodu od 15.06.2010. godine – 15.08.2010. godine, izvršen je nadzor kod 3.593 subjekta i utvrđeno je 3.091 nepravilnost, od kojih se veći broj odnosi na rad stranaca koji su nezakonito angažovani, koji ne poseduju niti radnu niti boravišnu dozvolu. U slučajevima nepoštovanja pozitivnih propisa u pogledu zapošljavanja kako rezidenata tako i nerezidenata, inspekcija istima privremeno zabranjuje rad do otklanjanja nepravilnosti, odnosno do regulisanja radno pravnog statusa zaposlenih. Takođe, inspektori rada su pored slučajeva rada na crno, istakli zabranu rada i u dijelu zaštite na radu kada se utvrdi da je ugroženo zdravlje i život zaposlenih, ili kada poslodavac ne postupi po rješenju inspekcije. U periodu od 15.06.2010. godine – 15.08.2010. godine, izrečeno je 128 privremenih mjera zabrana rada, zatim 1.346 mandatnih kazni u ukupnom iznosu od 222.090,0 €, a kod 1.158 subjekata naloženo je otklanjanje nepravilnosti, dok je za neizvršena ukazivanja doneseno 276 rješenja i izvršenja istih u toku. Naprijed navedenim rezultatima doprinijela je i sama saradnja zaposlenih sa inspekcijom rada. Najveći broj povreda se odnosi na nepostovanje Zakona o zapošljavanju i radu stranaca, na šta ukazuje činjenica da je u nelegalnom radnom odnosu zatečeno više od 600 stranih državljana, ali može se konstatovati da isti broj ne bi trebalo da nas zabrinjava ako uzimemo u obzir zvanične podatke ZZZCG, da je samo u toku juna ove godine izdato 2.094 radnih dozvola, a u periodu od 01.01. 2010. Godine – 09.08.2010. godine izdato 9.183 radnih dozvola. (Izvor: Vlada Crne Gore) 09.08.2010 17:00 The Government of Montenegro begins implementation of "economic citizenship'' The Government of Montenegro, based on the Decisions of criteria for determining the scientific, economic, cultural and sports interests, opened the program "economic citizenship". According to that, it is already prepared the Guidelines on the application of criteria based on which existence it is estimated the economic interests of Montenegro to gain Montenegrin citizenship by admission. By adopting this guidance, it is created the opportunity for businessmen of world reputation to gain a limited number of Montenegrin passports by direct investment in Montenegro and its economy, as well as donating to the state budget. As part of the qualifying process for the acquisition of Montenegrin citizenship, interested parties will have to invest a minimum of 500,000 EUR in Montenegro, of which a part will be directly paid to the state budget. This program, which applied to some other countries such as Austria, Canada, USA and others, aims to encourage the world's most successful businessmen to relocate their company headquarters in Montenegro, introduce new technology; innovation and know-how in Montenegro, significantly improve the transfer of necessary knowledge and skills and create new employment opportunities. Acknowledgement of applicants will be reviewed also by independent consulting house, on the basis of whose report the Ministry of Finance gives an opinion that instructs the Ministry of Internal Affairs and Public Administration, which determinates the citizenship by application. The Government of Montenegro will cooperate on this program with the world's most recognized law firms in this field, as well as consulting companies, in order to create conditions for the possibility to acquire Montenegrin citizenship but only for those business people who have undisputed business biography and financial opportunities which will contribute to development of Montenegrin economy. All applicants will be checked by the strictest international standards and criteria, clearly set by the Government of Montenegro which will contribute to legal security in the acquisition of Montenegrin citizenship. After creating a legal framework for the free flow of capital, by creating an attractive business environment, further implementation of this program will attract reputable foreign investors, individuals and the capital in Montenegro, which will contribute to the growth of a positive image of Montenegro on the economic map of the world. Montenegro with this proves once again that is open to foreign economic and intellectual capital, which will contribute to strengthening the capacity of countries, exchange of know-how, developing economies and business in general. This is an innovation in our region, which will provide a competitive advantage in the contest for foreign investors. (Source: Government of Montenegro) 09.08.2010 17:00 Vlada Crne Gore počinje realizaciju programa „ekonomsko državljanstvo’’ Vlada Crne Gore, na osnovu Odluke o kriterijumima za utvrđivanje naučnog, privrednog, ekonomskog, kulturnog i sportskog interesa otvara program „ekonomsko državljanstvo“. U skladu sa tim, pripremiljeno je Uputstvo o primjeni kriterijuma na osnovu kojih se cijeni postojanje privrednog i ekonomskog interesa Crne Gore za sticanje crnogorskog državljanstva prijemom. Donošenjem ovog uputstva stvorene su mogućnosti da poznati poslovni ljudi kredibline svjetske reputacije steknu ograničeni broj crnogorskih pasoša direktnim investiranjem u Crnu Goru i njenu ekonomiju, kao i doniranjem u državni budžet. Kao dio kvalifikacionog procesa za sticanje crnogorskog državljanstva, zainteresovana lica će morati da investiraju minimum 500,000 eura u Crnu Goru, od čega će dio sredstava biti direktno uplaćena u državni budžet. (Izvor: Vlada Crne Gore) 27.07.2010 10:35 Pripremljen Koncesioni akt za davanje koncesija za vršenje poslova preuzimanja, sakupljanja i obrade posebnih vrsta otpada Ministarstvo uređenja prostora i zaštite životne sredine sprovodi Javnu raspravu u cilju usvajanja Koncesionog akta za davanje koncesija za preuzimanje, sakupljanje i obradu posebnih vrsta otpada u Crnoj Gori, koji se primjenjuje na istrošene baterije i akumulatore, otpadne gume, otpadna vozila, otpad od električnih i elektronskih proizvoda i otpadnu amabalažu. Javna rasprava će se održati od 29.07.2010. godine, do 18.08.2010. Koncesioni akt je pripremljen u skladu sa Zakonom o koncesijama i sadrži podatke, informacije i analize vezane za davanje koncesija za vršenje poslova preuzimanja, sakupljanja i obrade posebnih vrsta otpada u Crnoj Gori. Ovaj dokument objašnjava aktivnosti i definiše obaveze ponuđača za vrijeme trajanja javnog nadmetanja, kao i uslove i obaveze koje treba da ispunjava koncesionar u vrijeme obavljanja koncesionih djelatnosti. Koncesija se daje za vršenje poslova preuzimanja, sakupljanja i obrade posebnih vrsta otpada na teritoriji Crne Gore. Granice područja, oblasti, prostora i lokacije na kojima će se vršiti koncesiona djelatnost utvrđene su na osnovu Strateškog master plana za upravljanje čvrstim otpadom u kojem su definisana područja međuopštinskih mreža regionalnih deponija. Rok trajanja koncesije za poslove sakupljanja, preuzimanja i prerade pojedinih posebnih vrsta otpada je od 5 godina (minimalni rok) do 10 godina (maksimalni rok). (Izvor: Vlada Crne Gore) Concession Act prepared for the granting the concessions to perform the tasks of acquisitions, collection and processing of specific types of waste Ministry of Physical Planning and Environment conducted a public hearing for the purpose of adopting the act of concession for the granting of concessions to download, collection and processing of specific types of waste in Montenegro, which is applied to the worn out batteries and accumulators, waste rubber, waste vehicles, waste from electrical and electronic products. Public hearing will be held from 29/07/2010 until 18/08/2010. Concession Act was prepared in accordance with the Law on Concessions and contains data, information and analysis related to the granting of concessions to perform the tasks of acquisitions, collection and processing of specific types of waste in Montenegro. Ovaj skup predstavlja najznačajniju ICT manifestaciju u regionu koja okuplja svjetske tehnološke lidere i vodeće informatičke kompanije sa naših prostora. The subject of the lease contract of the state land area of 502,858.3 m2 for in the period of 20 years, at a price of € 0.37 for 1 m2. Anticipated annual production of wind power plant is about 100 GWh, and for the implementation of the project is planned an investment of 65 million euros. Fairs Energias Renovables, S. A. that is a leader in the consortium, the renowned Spanish company based in Barcelona, which is engaged in designing, building and managing wind power plants. Fairs was established in 2000., and for now is represented in nine countries on three continents. Partner in the consortium, Celebic DOO is a known Montenegrin construction company, founded in 1991. in Podgorica. With the strategy of Energy Development in Montenegro until 2025. it was planned the development of wind power plants, and the study showed the potential of renewable resources like potential for wind, hydro, and despite the large potential of solar energy and biomass. Accordingly, the Ministry of Economy in 2008. and 2009. issued five licenses for measurement at different locations, with the goal of developing wind power plants on the territory of Montenegro. (Source: Government of Montenegro) Potpisan ugovor o zakupu zemljišta i izgradnji vjetroelektrane na lokalitetu Možura Ministar ekonomije Branko Vujović potpisao je danas Ugovor o zakupu zemljišta i izgradnji vjetroelektrane na lokalitetu Možura (opštine Ulcinj i Bar), sa konzorcijumom Fersa & Čelebić, o zakupu zemljišta u državnoj svojini i izgradnji vjetroelektrane instalisane snage 46 MW. Predmet Ugovora je zakup državnog zemljišta površine 502.858,3 m2 u periodu od 20 godina, po cijeni od 0,37 € za 1 m2. Predviđena godišnja proizvodnja vjetroelektrane je oko 100 GWh, a za realizaciju tog projekta predviđena je investicija od 65 miliona eura. Fersa Energias Renovables, S. A. koja je lider u konzorcijumu, renomirana je španska firma sa sjedištem u Barseloni, koja se bavi projektovanjem, izgradnjom i upravljanjem vjetroelektrana. Fersa je osnovana 2000. godine i za sada je zastupljena u devet zemalja na tri kontinenta. Partner u konzorcijumu, Čelebić D.O.O. je poznata crnogorska građevinska kompanija, osnovana 1991. godine u Podgorici. Strategijom razvoja energetike u Crnoj Gori do 2025. godine planiran je razvoj vjetroelektrana, a Studija potencijala obnovljivih izvora pokazala je značajan potencijal vjetra, pored velikog hidropotencijala i potencijala sunčeve energije i biomase. U skladu sa tim, Ministarstvo ekonomije je tokom 2008. i 2009. godine izdalo pet dozvola za mjerenje na različitim lokalitetima, čiji je cilj razvoj vjetroelektrana na području Crne Gore. Na sjednici je razmatrana realizacija aktivnosti predviđenih Akcionim planom, uz konstataciju je da je najveći broj kratkoročnih aktivnosti realizovan u predviđenom roku. Savjet je informisan od Međunarodne finansijske korporacije (IFC) da će prilikom pripreme Izvještaja Svjetske banke o lakoći poslovanja za 2010. godinu biti evidentiran napredak koji je Crna Gora ostvarila u prethodnom periodu u oblastima plaćanja poreza i započinjanja biznisa kroz uvođenje poreskih olakšica i izmjenu poreskih zakona, smanjenje stopa poreza na dohodak fizičkih lica, uključujući i doprinose za socijalno osiguranje. Session of the Council for Regulatory Reform and improvement of business environment Today was held the XI session of the Council for regulatory reform and improving the business environment, which was chaired by the President of the Council - Deputy Prime Minister and Minister of Finance Igor Luksic. At the meeting it was discussed the implementation of activities envisaged in the Action Plan, concluding that most short-term activities were carried out in due time. The Council was informed by the International Finance Corporation (IFC) that in the process of preparing the Report of the World Bank about the facility of doing business for 2010 it will be recorded the progress made by Montenegro in the previous period in the areas of paying taxes and starting a business through the introduction of tax incentives and change of tax laws, reducing tax rates on personal income, including social security contributions. When it comes to indicators for starting a business, the process is greatly simplified by introducing a single registration form to be submitted to the Tax Administration and replaces 16 different forms that were previously submitted to four different institutions. The Council considered the recommendations of the Report (so-called "White Book") of foreign investors in Montenegro on the investment climate in the country. The Council gave instruction to the sectorial institutions within their jurisdiction, to consider the proposed recommendations in order to improve the business environment including in the Action Plan Reforms for facility of doing business for the next year. The new site will include already published advertisement for construction companies, information about the concept, and a series of questions and answers related to the various aspects of project 1000 + apartments. The representative of Germany’s company WTE which in cooperation with the Municipality of Budva realize the project, Mr. Miroslav Oster, presented the undertaken activities so far and those that follow the plan of building a system that will solve, in a better way, the waste water issue and permanently solve the problems in this field. It is envisaged the construction of four plants for Budvanska Rivijera as well as reconstruction and rehabilitation of existing sewerage system. The project will be implemented in two phases, the first to be completed by the end of next year; it will be built the plants for the town Budva and for Sveti Stefan, and then will be built the plant for Rezevici, Buljarica and Jaz. The total project cost is about 60 million €, and the implementation period is four years. It is a project that is of utmost importance for the Municipality of Budva, which is in a phase when it could be started work, which is of crucial importance for the protection of coastal areas and clean sea that is a precondition for further tourism development. Predstavnik njemačke kompanije WTE u saradnji sa kojom, Opština Budva realizuje projekat, Miroslav Ošter predstavio je do sada preduzete aktivnosti kao i one koje slijede na planu izgradnje sistema koji će omogućiti kvalitetniji način zbrinajavanja otpadnih voda i trajno riješiti probleme u toj oblasti. Predviđena je izgradnja četiri postrojenja za Budvansku rivijeru kao i rekonstrukcija i sanacija postojećeg kanalizacionog sistema. Preparing of the new Law on Execution Procedure of Montenegro

The Ministry of Justice of Montenegro under its authority is preparing changes of the Law on Executive Procedure.

Draft of the Law of Executive Procedure (hereinafter “Draft”) is published on the Website of Ministry of Justice of Montenegro, which indicated that the executive procedure will be covered with many essential reforms, that will contribute the more efficiency of the same.

It is important to stress that with adoption of new Law of Executive Procedure, a large part of authority will be assigned to executors, who will have to fulfill the terms proscribed by the Law of Executive Procedure for that function, which indicates importance of the function that will performed.

According to the “Draft”, we want to point out to several important items which entities should take into consideration during the organization of their business, in order to collect their claims more successfully, after adoption of the new Law of Executive Procedure.

Namely, the Law of Executive Procedure of Montenegro in force prescribes that the invoice is authentic document, but above mentioned “Draft” stipulates that the invoice have to be followed by delivery note or other evidence of issued services or delivered goods.

Also, this draft of the law introduces new acts that will be considered as authentic documents, as it follows : the mortgage contract and pledge statement, and notary act which is enforceable, and foreign notary act if it contains all elements that convenient for execution.

Draft of the above said Law contains efficiency innovation, namely the motion of execution could be based on the foreign authentic document (invoice etc.) if there are factual, unless it is not diplomatic or judicial reciprocity. Taking into consideration this innovation, the debt collection for the foreigner and foreign entities will be simpler, because according to the Montenegrin legislation in force foreigner or foreign entities can submit only the lawsuit for debt collection based on the foreign documents that procedure is much longer than executive procedure.

The adoption of the new Law of Executive Procedure is expected until the end of the 2010.

Pripremanje novog Zakona o izvršnom postupku Crne Gore.

Ministarstvo pravde Crne Gore, u okviru svojih ingerencija priprema novi Zakon o izvršnom postupku Crne Gore.

Na sajtu Ministarstva pravde Crne Gore objavljena je Radna verzija Zakona o izvršnom postupku (u daljem tekstu „Radna verzija zakona“), iz čije sadržine se može uočiti da izvršnom postupku predstoje korijenite reforme, koje će doprinijeti veoma značajnoj efikasnosti istog.

Bitno je napomenuti da će se donošenjem novog Zakona o izvršnom postupku, veliki dio nadležnosti ustupiti izvršiteljima, koji će za tu funkciju morati ispunjavati zakonom propisane uslove, što ukazuje na značaj funkcije koju će obavljati.

Iz Radne verzije zakona, izdvojićemo nekoliko bitnih novina koje predstoje, a koje bi privredni ali i drugi subjekti već trebali imati u vidu prilikom organizovanja poslovanja, kako bi nakon donošenja novog Zakona o izvršnom postupku bili u mogućnosti efikasno naplatiti svoja potraživanja.

Naime, Zakon o izvršnom postupku koji je na pravnoj snazi, propisuje da je faktura vjerodostojna isprava, dok Radna verzija zakona predvidja da fakturu prati otpremnica ili drugi dokaz o izvršenoj usluzi domaćeg ili stranog pravnog lica. Prednje ukazuje da bi privredni i drugi subjekti već trebali uskladiti svoje poslovanje u ovom dijelu, i praktikovati da svaku izdatu fakturu prati dokaz o izvršenoj usluzi.

Takodje, ova Radna verzija zakona uvodi dva nova akta, koja će se smatrati vjerodostojnom ispravom, i to ugovor o hipoteci i založna izjava, kao i notarski akt koji predstavlja izvršni naslov, te strani notartski akt ako sadrži sve elemente pogodne za izvršenje.

Veoma značajna novina koja se može uočiti u Radnoj verziji zakona, jeste da će se prijedlog za izvršenje saznivati i na stranoj vjerodostojnoj ispravi (fakturi i sl.) pod uslovom postojanja reciprociteta koji može biti i faktiči, ukoliko nije diplomatski ili zakonski. Shodno prednjem, naplata potraživanja stranih lica bi se u velikoj mjeri olakšala, jer u skladu sa trenutnim zakonodavstvom strana lica mogu istaći zahtjeve za naplatu svojih potraživanja po osnovu vjerodostojnih isprava samo u parnici, koji postupak mnogo duže traje od izvršnog.

Usvajanje novog Zakona o izvršnom postupku očekuje se do kraja 2010. godine.

Ministry of Labor and Social Welfare submitted a report on the work of Labor Inspection in the six coastal municipalities for the period from 15.06. 2010 until 15.08.2010

This year like as previous years the Ministry of Labor and Social Welfare, before tourist season, adopted the Action Plan for carrying out the inspection surveillance in the part of the implementation of regulations governing labor relations, employment and safety at work, particularly in the part of the implementation of measures to:
- Employees receive regular salary and allowance;- Employers provide to the employees adequate protection at work;- The employer conducts training and training of employees for safe work;- Employers provide Specialist medical review of employees who work in jobs with high risk; as well as- Control the working conditions and environmental regulations on risk assessment in accordance with the Law on Protection at Work.

In the period from 15.06.2010 until 15.08.2010 was performed inspection at 3593 subjects and found 3091 irregularities, mostly related to the work of foreigners who do not poses neither Working or Resident permit.
In cases of non compliance with regulations in terms of employment of residents and nonresidents, Labor Inspection temporarily prohibits work until employer eliminate irregularities, in other words until regulating the labor and legal status of employees.

Also, Labor Inspectors are in addition to cases of illegal work, emphasized the prohibition of work and part of safety when it is determined that threatened the health and lives of employees, or if the employer fails to comply with the decision of the inspection.

In the period from 15.06.2010 until 15.08.2010, Labor Inspection has issued 128 interim measures of prohibition, 1346 fines in total amount of 222,090.00 €, and for 1158 were ordered the removal of irregularities subjects, while the default of pointing passed 276 resolutions and the execution thereof in progress. Above mentioned results were contributed by cooperation of employees with the Labor Inspection.
The largest number of injuries is related to violations of the Law on employment and work of foreigners, which is demonstrated by the fact that more than 600 foreigners were found without Work or Resident permit, however it can be concluded that the same number should not concern us considering the official data Employment Agency of Montenegro, that June were issued 2094 Work permits, and in the period from 01.01. 2010 until 09.08.2010 were issued 9183 work permits.

Ministry of Labor and Social Welfare points out that in addition to increased surveillance on the territory of the coastal municipalities plan also to increase the activity in the tourist areas in the north of Montenegro.

Ministarstvo rada i socijalnog staranja predalo izvještaj o radu Inspekcije rada u šest primorskih opština za period od 15.06. 2010. Godine – 15.08.2010. godine

Ove kao i predhodnih godina Ministarstvo rada i socijalnog staranja, prije početka turističke sezone, donijelo je Akcioni plan vršenja inspekcijskog nadzora u dijelu primjene propisa kojima su uređeni radni odnosi, zapošljavanje i zaštita na radu, tačnije u dijelu sprovođenja mjera da:

U periodu od 15.06.2010. godine – 15.08.2010. godine, izvršen je nadzor kod 3.593 subjekta i utvrđeno je 3.091 nepravilnost, od kojih se veći broj odnosi na rad stranaca koji su nezakonito angažovani, koji ne poseduju niti radnu niti boravišnu dozvolu.
U slučajevima nepoštovanja pozitivnih propisa u pogledu zapošljavanja kako rezidenata tako i nerezidenata, inspekcija istima privremeno zabranjuje rad do otklanjanja nepravilnosti, odnosno do regulisanja radno pravnog statusa zaposlenih. Takođe, inspektori rada su pored slučajeva rada na crno, istakli zabranu rada i u dijelu zaštite na radu kada se utvrdi da je ugroženo zdravlje i život zaposlenih, ili kada poslodavac ne postupi po rješenju inspekcije.

U periodu od 15.06.2010. godine – 15.08.2010. godine, izrečeno je 128 privremenih mjera zabrana rada, zatim 1.346 mandatnih kazni u ukupnom iznosu od 222.090,0 €, a kod 1.158 subjekata naloženo je otklanjanje nepravilnosti, dok je za neizvršena ukazivanja doneseno 276 rješenja i izvršenja istih u toku. Naprijed navedenim rezultatima doprinijela je i sama saradnja zaposlenih sa inspekcijom rada.

Najveći broj povreda se odnosi na nepostovanje Zakona o zapošljavanju i radu stranaca, na šta ukazuje činjenica da je u nelegalnom radnom odnosu zatečeno više od 600 stranih državljana, ali može se konstatovati da isti broj ne bi trebalo da nas zabrinjava ako uzimemo u obzir zvanične podatke ZZZCG, da je samo u toku juna ove godine izdato 2.094 radnih dozvola, a u periodu od 01.01. 2010. Godine – 09.08.2010. godine izdato 9.183 radnih dozvola.

Ministarstvo rada i socijalnog staranja ističe da se pored pojačanog nadzora na teritoriji primorskih opština planira i pojačana aktivnost u turističkim centrima na sjeveru Crne Gore.

The Government of Montenegro, based on the Decisions of criteria for determining the scientific, economic, cultural and sports interests, opened the program "economic citizenship". According to that, it is already prepared the Guidelines on the application of criteria based on which existence it is estimated the economic interests of Montenegro to gain Montenegrin citizenship by admission.

By adopting this guidance, it is created the opportunity for businessmen of world reputation to gain a limited number of Montenegrin passports by direct investment in Montenegro and its economy, as well as donating to the state budget.

As part of the qualifying process for the acquisition of Montenegrin citizenship, interested parties will have to invest a minimum of 500,000 EUR in Montenegro, of which a part will be directly paid to the state budget.

This program, which applied to some other countries such as Austria, Canada, USA and others, aims to encourage the world's most successful businessmen to relocate their company headquarters in Montenegro, introduce new technology; innovation and know-how in Montenegro, significantly improve the transfer of necessary knowledge and skills and create new employment opportunities.

Acknowledgement of applicants will be reviewed also by independent consulting house, on the basis of whose report the Ministry of Finance gives an opinion that instructs the Ministry of Internal Affairs and Public Administration, which determinates the citizenship by application.

The Government of Montenegro will cooperate on this program with the world's most recognized law firms in this field, as well as consulting companies, in order to create conditions for the possibility to acquire Montenegrin citizenship but only for those business people who have undisputed business biography and financial opportunities which will contribute to development of Montenegrin economy.

All applicants will be checked by the strictest international standards and criteria, clearly set by the Government of Montenegro which will contribute to legal security in the acquisition of Montenegrin citizenship.

After creating a legal framework for the free flow of capital, by creating an attractive business environment, further implementation of this program will attract reputable foreign investors, individuals and the capital in Montenegro, which will contribute to the growth of a positive image of Montenegro on the economic map of the world.

Montenegro with this proves once again that is open to foreign economic and intellectual capital, which will contribute to strengthening the capacity of countries, exchange of know-how, developing economies and business in general. This is an innovation in our region, which will provide a competitive advantage in the contest for foreign investors.

The Montenegrin Government retains the discretion not to grant citizenship, even in cases of positive opinion of independent company and the relevant ministries.

Vlada Crne Gore, na osnovu Odluke o kriterijumima za utvrđivanje naučnog, privrednog, ekonomskog, kulturnog i sportskog interesa otvara program „ekonomsko državljanstvo“. U skladu sa tim, pripremiljeno je Uputstvo o primjeni kriterijuma na osnovu kojih se cijeni postojanje privrednog i ekonomskog interesa Crne Gore za sticanje crnogorskog državljanstva prijemom.

Donošenjem ovog uputstva stvorene su mogućnosti da poznati poslovni ljudi kredibline svjetske reputacije steknu ograničeni broj crnogorskih pasoša direktnim investiranjem u Crnu Goru i njenu ekonomiju, kao i doniranjem u državni budžet.

Kao dio kvalifikacionog procesa za sticanje crnogorskog državljanstva, zainteresovana lica će morati da investiraju minimum 500,000 eura u Crnu Goru, od čega će dio sredstava biti direktno uplaćena u državni budžet.

Pripremljen Koncesioni akt za davanje koncesija za vršenje poslova preuzimanja, sakupljanja i obrade posebnih vrsta otpada

Ministarstvo uređenja prostora i zaštite životne sredine sprovodi Javnu raspravu u cilju usvajanja Koncesionog akta za davanje koncesija za preuzimanje, sakupljanje i obradu posebnih vrsta otpada u Crnoj Gori, koji se primjenjuje na istrošene baterije i akumulatore, otpadne gume, otpadna vozila, otpad od električnih i elektronskih proizvoda i otpadnu amabalažu. Javna rasprava će se održati od 29.07.2010. godine, do 18.08.2010.

Koncesioni akt je pripremljen u skladu sa Zakonom o koncesijama i sadrži podatke, informacije i analize vezane za davanje koncesija za vršenje poslova preuzimanja, sakupljanja i obrade posebnih vrsta otpada u Crnoj Gori. Ovaj dokument objašnjava aktivnosti i definiše obaveze ponuđača za vrijeme trajanja javnog nadmetanja, kao i uslove i obaveze koje treba da ispunjava koncesionar u vrijeme obavljanja koncesionih djelatnosti.

Koncesija se daje za vršenje poslova preuzimanja, sakupljanja i obrade posebnih vrsta otpada na teritoriji Crne Gore. Granice područja, oblasti, prostora i lokacije na kojima će se vršiti koncesiona djelatnost utvrđene su na osnovu Strateškog master plana za upravljanje čvrstim otpadom u kojem su definisana područja međuopštinskih mreža regionalnih deponija.

Rok trajanja koncesije za poslove sakupljanja, preuzimanja i prerade pojedinih posebnih vrsta otpada je od 5 godina (minimalni rok) do 10 godina (maksimalni rok).

Concession Act prepared for the granting the concessions to perform the tasks of acquisitions, collection and processing of specific types of waste

Ministry of Physical Planning and Environment conducted a public hearing for the purpose of adopting the act of concession for the granting of concessions to download, collection and processing of specific types of waste in Montenegro, which is applied to the worn out batteries and accumulators, waste rubber, waste vehicles, waste from electrical and electronic products. Public hearing will be held from 29/07/2010 until 18/08/2010.

Concession Act was prepared in accordance with the Law on Concessions and contains data, information and analysis related to the granting of concessions to perform the tasks of acquisitions, collection and processing of specific types of waste in Montenegro. This document explains the activities and responsibilities defined by the bidder for the duration of the public auction, as well as the terms and conditions to be met by the concessionaire during the concession business performance.

Concessions are given to perform tasks of acquisitions, collection and processing of specific types of waste in the territory of Montenegro. The boundaries of the area, space and location that will make concession activity were determined on the basis of the Strategic master plan for solid waste management in the defined area of inter-municipal network of regional landfills.

The duration of the concession for business gathering, retrieval and processing of certain special types of waste is of 5 years (minimum term) to 10 years (maximum term).

U organizaciji Ministarstva za informaciono društvo Crne Gore i konsultantske kompanije Biznis Link, u Budvi će se, u periodu od 26. septembra do 2. oktobra, održati XVII Festival ICT dostignuća – INFOFEST 2010.

Ovaj skup predstavlja najznačajniju ICT manifestaciju u regionu koja okuplja svjetske tehnološke lidere i vodeće informatičke kompanije sa naših prostora. Pored prezentacija uspješnih projekata, u programu INFOFEST-a je i predstavljanje najuspješnijih autorskih radova, međunarodna konferencija o regulatornom djelovanju u oblasti elektronskih komunikacija, nekoliko seminara i edukativnih programa, kao i pozivna predavanja uglednih ICT eksperata.

Koncept ovogodišnjeg Festivala osvježen je novom festivalskom formom pod nazivom „INFOFEST-parlament“ u okviru koje će biti raspravljano o aktuelnim problemskim temama koje imaju značaja za ubrzanje razvoja informatičkog društva. Economy Minister Branko Vujovic signed an agreement for the lease of land and building of wind power plant at the site MOZURA (Municipality Ulcinj and Bar), with the consortium Fairs & Celebic, regarding the lease of land in state ownership and building of wind power plant, installed capacity of 46 MW. The subject of the lease contract of the state land area of 502,858.3 m2 for in the period of 20 years, at a price of € 0.37 for 1 m2. Anticipated annual production of wind power plant is about 100 GWh, and for the implementation of the project is planned an investment of 65 million euros. Fairs Energias Renovables, S. A. that is a leader in the consortium, the renowned Spanish company based in Barcelona, which is engaged in designing, building and managing wind power plants. Fairs was established in 2000., and for now is represented in nine countries on three continents. Partner in the consortium, Celebic DOO is a known Montenegrin construction company, founded in 1991. in Podgorica.

With the strategy of Energy Development in Montenegro until 2025. it was planned the development of wind power plants, and the study showed the potential of renewable resources like potential for wind, hydro, and despite the large potential of solar energy and biomass. Accordingly, the Ministry of Economy in 2008. and 2009. issued five licenses for measurement at different locations, with the goal of developing wind power plants on the territory of Montenegro.

Once delivered the analysis of potential wind and positive opinions of the transmission system operator and the Ministry of Physical Planning and Environment, Ministry of Economy is in accordance with the Regulation of wind power plants, 24 December 2009. announced a public invitation for the selection of investors to lease of land for wind power plant and construction at the site MOZURA (municipalities Ulcinj and Bar) and Krnov (municipalities of Niksic and Savnik). Before the publication of the public invitation the Ministry of Economy on 30 September 2009. published invitation for expressions of interest to investors interested in building wind power plants, to which responded 16 investors.

After opening the tender on 24th February 2010. the Evaluation Committee has entered in a process of review and evaluation of bids, and later negotiations with the selected investor on the site of MOZURA.

Potpisan ugovor o zakupu zemljišta i izgradnji vjetroelektrane na lokalitetu Možura

Ministar ekonomije Branko Vujović potpisao je danas Ugovor o zakupu zemljišta i izgradnji vjetroelektrane na lokalitetu Možura (opštine Ulcinj i Bar), sa konzorcijumom Fersa & Čelebić, o zakupu zemljišta u državnoj svojini i izgradnji vjetroelektrane instalisane snage 46 MW. Predmet Ugovora je zakup državnog zemljišta površine 502.858,3 m2 u periodu od 20 godina, po cijeni od 0,37 € za 1 m2. Predviđena godišnja proizvodnja vjetroelektrane je oko 100 GWh, a za realizaciju tog projekta predviđena je investicija od 65 miliona eura. Fersa Energias Renovables, S. A. koja je lider u konzorcijumu, renomirana je španska firma sa sjedištem u Barseloni, koja se bavi projektovanjem, izgradnjom i upravljanjem vjetroelektrana. Fersa je osnovana 2000. godine i za sada je zastupljena u devet zemalja na tri kontinenta. Partner u konzorcijumu, Čelebić D.O.O. je poznata crnogorska građevinska kompanija, osnovana 1991. godine u Podgorici.

Strategijom razvoja energetike u Crnoj Gori do 2025. godine planiran je razvoj vjetroelektrana, a Studija potencijala obnovljivih izvora pokazala je značajan potencijal vjetra, pored velikog hidropotencijala i potencijala sunčeve energije i biomase. U skladu sa tim, Ministarstvo ekonomije je tokom 2008. i 2009. godine izdalo pet dozvola za mjerenje na različitim lokalitetima, čiji je cilj razvoj vjetroelektrana na području Crne Gore.

Nakon dostavljene analize potencijala vjetra i pozitivnih mišljenja operatora prenosnog sistema i Ministarstva uređenja prostora i zaštite životne sredine, Ministarstvo ekonomije je u skladu sa Uredbom o vjetroelektranama, 24. decembra 2009. godine objavilo Javni oglas za izbor investitora za zakup zemljišta i izgradnju vjetroelektrane za lokalitete Možura (opštine Ulcinj i Bar) i Krnovo (opštine Nikšić i Šavnik). Prije objavljivanja Javnog oglasa Ministarstvo ekonomije je 30. septembra 2009. godine objavilo Poziv za izražavanje interesovanja investitorima zainteresovanim za izgradnju vjetroelektrana, na koji se odazvalo 16 investitora.

Nakon otvaranja ponuda 24. februara 2010. godine, Tenderska komisija je ušla u proces pregleda i vrednovanje ponuda, a kasnije i pregovora sa odabranim investorom na lokalitetu Možura.

Održana sjednica Savjeta za regulatornu reformu i unapređenje poslovnog ambijenta

Danas je održana XI sjednica Savjeta za regulatornu reformu i unapređenje poslovnog ambijenta, kojom je predsjedavao predsjednik Savjeta - potpredsjednik Vlade i ministar finansija dr Igor Lukšić. Na sjednici je razmatrana realizacija aktivnosti predviđenih Akcionim planom, uz konstataciju je da je najveći broj kratkoročnih aktivnosti realizovan u predviđenom roku.

Savjet je informisan od Međunarodne finansijske korporacije (IFC) da će prilikom pripreme Izvještaja Svjetske banke o lakoći poslovanja za 2010. godinu biti evidentiran napredak koji je Crna Gora ostvarila u prethodnom periodu u oblastima plaćanja poreza i započinjanja biznisa kroz uvođenje poreskih olakšica i izmjenu poreskih zakona, smanjenje stopa poreza na dohodak fizičkih lica, uključujući i doprinose za socijalno osiguranje. Kad je riječ o indikatorima za započinjanje biznisa, proces je značajno pojednostavljen uvođenjem jedinstvene registracione forme koja se podnosi Poreskoj upravi i zamjenjuje 16 različitih obrazaca koje su se ranije podnosili u četiri različite institucije.

Savjet je razmatrao i preporuke iz Izvještaja (tzv. „bijela knjiga“) stranih investitora u Crnoj Gori o investicionoj klimi u zemlji. Savjet je zadužio resorne institucije da, u okviru svojih nadležnosti, razmotre predložene preporuke, kako bi u cilju unapređenja poslovnog ambijenta bile uključene u Akcioni plan reforme lakoće poslovanja za narednu godinu.

Savjet je razmatrao i dao podršku realizaciji aktivnosti na daljem unapređenju stanja u oblasti građevinskih dozvola, za koje je zaduženo Ministarstvo uređenja prostora i zaštite životne sredine. Savjet je usvojio informaciju Operativnog tima o realizovanom dijelu Inventure propisa i administrativnih postupaka.

Session of the Council for Regulatory Reform and improvement of business environment

Today was held the XI session of the Council for regulatory reform and improving the business environment, which was chaired by the President of the Council - Deputy Prime Minister and Minister of Finance Igor Luksic. At the meeting it was discussed the implementation of activities envisaged in the Action Plan, concluding that most short-term activities were carried out in due time.

The Council was informed by the International Finance Corporation (IFC) that in the process of preparing the Report of the World Bank about the facility of doing business for 2010 it will be recorded the progress made by Montenegro in the previous period in the areas of paying taxes and starting a business through the introduction of tax incentives and change of tax laws, reducing tax rates on personal income, including social security contributions. When it comes to indicators for starting a business, the process is greatly simplified by introducing a single registration form to be submitted to the Tax Administration and replaces 16 different forms that were previously submitted to four different institutions.

The Council considered the recommendations of the Report (so-called "White Book") of foreign investors in Montenegro on the investment climate in the country. The Council gave instruction to the sectorial institutions within their jurisdiction, to consider the proposed recommendations in order to improve the business environment including in the Action Plan Reforms for facility of doing business for the next year.

The Council has reviewed and expressed support for the implementation of activities to further improve of the situation in the area of construction permits, which is in jurisdiction of the Ministry for Spatial Planning and Environment. The Council adopted the Information from the Operations team about the realized part of an inventory of regulations and administrative procedures.

At the web address www.1000plus.me from today it is active web site dedicated to the project for credit for households that have not solved housing problems, which under the name 1000 + apartments, is implemented by the Government of Montenegro, through the Ministry of Spatial Planning and Environment, in cooperation with the Council of Europe Development Bank (CEB) and Montenegrin banks.

The new site will include already published advertisement for construction companies, information about the concept, and a series of questions and answers related to the various aspects of project 1000 + apartments. At this stage the site is mainly devoted to construction companies, and from 23 July there will be advertisement for the Montenegrin bank. The advertisement for Montenegrin citizens will be published on 3 September, when in function will be the info center for the citizens, at the number 19915, as well as interactive map of Montenegro with the apartments offer that are eligible for participation in the Project 1000 +.

Otherwise, the Government of Montenegro, on 11 June 2010, is announced the Public Invitation for companies from the area of construction industry and investors, to participate in project of loans for households that have not solved their housing problems. The government has invited companies to bid constructed of unfinished housing units, which will apply to this project.

The main objective of the Project 1000 + is to enable to Montenegrin citizens that in the simple, fair and cost-effective way get their own apartment.

Na adresi www.1000plus.me od danas je aktivan web sajt posvećen projektu kredita za domaćinstva koja nemaju riješeno stambeno pitanje, koji, pod nazivom 1000+ stanova, realizuje Vlada Crne Gore, preko Ministarstva uređenja prostora i zaštite životne sredine, a u saradnji sa Razvojnom bankom Savjeta Evrope (CEB) i crnogorskim bankama.

Na novom sajtu će se nalaziti već objavljen oglas za građevinske kompanije, informacije o konceptu, kao i niz pitanja i odgovora vezanih za razne aspekte projekta 1000+ stanova. Sajt je u ovoj fazi uglavnom posvećen građevinskim kompanijama, a od 23. jula će se na njemu naći oglas za crnogorske banke. Oglas za građane Crne Gore biće objavljen 3. septembra, od kada će u funkciji biti i Info centar za građane na broju 19915, kao i interaktnivna mapa Crne Gore sa ponudom stanova koji su ispunili uslove za učešće u projektu 1000+.

Inače, Vlada Crne Gore je, 11. juna 2010. godine, raspisala Javni poziv za privredna društva u oblasti građevinarstva i investitore, za učešće u Projektu kredita za domaćinstva koja nemaju riješeno stambeno pitanje. Vlada je pozvala privredna društva da ponude izgrađene i neizgrađene stambene jedinice, koje će konkurisati u ovom Projektu.

Glavni cilj projekta 1000+ jeste da omogući građanima Crne Gore da na jednostavan, pravičan i ekonomski isplativ način dođu do sopstvenog stana.

Adopted the text of the Contract on lease of state-owned land and wind power building for the Krnovo

The Government of Montenegro at today's session adopted the text of the Contract on lease of state-owned land and wind power building for the Krnovo, Municipality of Niksic, with a consortium Ivica Consulting GmbH and Mitsubishi Heavy Industries. The contract includes the construction of wind power installed capacity 50 MW, with the possibility of increasing by the additional 22 MW. Anticipated investment is 70, or 90 million. The duration of land lease is 20 years and the amount of the lease of state property is 0.10 € per m2.

Mitsubishi Heavy Industries is reputable Japanese company, headquartered in Tokyo, and it existed since 1884. Mitsubishi is one of the leading manufacturers of wind turbines with a total of 4124 installed MW so far in the world. Company Ivica Consulting GmbH, headquartered in Vienna, and its offices in Croatia, Montenegro and Turkey, was founded in 1991. The company provides consulting services to leading engineering and trading companies in the industrial production and processing of steel and other materials.

Usvojen tekst Ugovora o zakupu zemljišta u državnoj svojini i izgradnji vjetroelektrane za lokalitet Krnovo

Vlada Crne Gore je na današnjoj sjednici usvojila tekst Ugovora o zakupu zemljišta u državnoj svojini i izgradnji vjetroelektrane za lokalitet Krnovo, Opština Nikšić, sa konzorcijumom Ivicom Consulting GmbH i Mitsubishi Heavy Industries. Ugovorom je predviđena izgradnja vjetroelektrane instalisane snage 50 MW, uz mogućnost povećanja za dodatnih 22 MW. Predviđena investicija je 70, odnosno 90 miliona eura. Trajanje zakupa zemljišta je 20 godina a visina zakupa državne svojine je 0,10 E po m2.

Mitsubishi Heavy Industries je reminovana japanska firma, sa sjedištem u Tokiju, a postoji od 1884 godine. Mitsubishi je jedan od vodećih proizvođača vjetroturbina sa ukupno instalisanih 4124 MW do sada u svijetu. Kompanija Ivicom Consulting GmbH, sa sjedištem u Beču, a predstavništvima u Hrvatskoj, Crnoj Gori i Turskoj, osnovana je 1991. godine. Kompanija pruža konsultantske usluge vodećim inžinjerskim i trgovačkim kompanijama iz oblasti industrije proizvodnje i obrade čelika i drugih materijala.

In today’s regular working visit to the Municipality of Budva, Minister of Tourism Mr. Predrag Nenezic and his colleagues visited the new university center, “Academy of Science Budva“ where is presented the project for treatment of waste water in the territory of Budva Municipality.

The representative of Germany’s company WTE which in cooperation with the Municipality of Budva realize the project, Mr. Miroslav Oster, presented the undertaken activities so far and those that follow the plan of building a system that will solve, in a better way, the waste water issue and permanently solve the problems in this field.

It is envisaged the construction of four plants for Budvanska Rivijera as well as reconstruction and rehabilitation of existing sewerage system.

The project will be implemented in two phases, the first to be completed by the end of next year; it will be built the plants for the town Budva and for Sveti Stefan, and then will be built the plant for Rezevici, Buljarica and Jaz.

The total project cost is about 60 million €, and the implementation period is four years. It is a project that is of utmost importance for the Municipality of Budva, which is in a phase when it could be started work, which is of crucial importance for the protection of coastal areas and clean sea that is a precondition for further tourism development.

U okviru današnje redovne radne posjete Opštini Budva, ministar turizma Predrag Nenezić i njegovi saradnici obišli su novi univerzitetski centar “Akademija znanja Budva“ gdje je održana prezentacija projekta za tretman otpadnih voda na teritoriji Opštine Budva.

Predstavnik njemačke kompanije WTE u saradnji sa kojom, Opština Budva realizuje projekat, Miroslav Ošter predstavio je do sada preduzete aktivnosti kao i one koje slijede na planu izgradnje sistema koji će omogućiti kvalitetniji način zbrinajavanja otpadnih voda i trajno riješiti probleme u toj oblasti.

Predviđena je izgradnja četiri postrojenja za Budvansku rivijeru kao i rekonstrukcija i sanacija postojećeg kanalizacionog sistema.

Projekat će se realizovati u dvije faze, u prvoj koja će biti završena do kraja sljedeće godine izgradiće se postrojenja za zahvat grada Budve i Svetog Stefana, a potom će biti izgrađena postrojenja za Reževiće, Buljaricu i Jaz.

Ukupna vrijednost projekta je oko 60 miliona eura, a rok realizacije je četiri godine. Riječ je projektu koji je od prioritetnog značaja za Opštinu Budva, a koji je doveden do faze u kojoj se mogu otpočeti radovi, što je od krucijalne važnosti za zaštitu priobalnog područja i čistoće mora koja je preduslov za dalji turistički razvoj.

Prime Minister Mr. Milo Djukanovic met with senior officials from the Council of Europe and the Court of Human Rights in Strasbourg

Prime Minister Mr. Milo Djukanovic met with several senior officials of the Council of Europe and the Court of Human Rights in Strasbourg, during the current session of the Parliamentary Assembly of the Council of Europe.

In an interview with the President of the Parliamentary Assembly of the Council of Europe Mr. Mevlut Čavašogluom, Prime Minister Mr. Djukanovic said that today meeting is a continuation of the dialogue initiated in Podgorica.

Mr. Čavušoglu stressed that Montenegro signed and ratified the Convention of the Council of Europe, with the remarkable dynamics, and that he sees the political will and determination of the country to implement reforms. Especially, he emphasized the role of Montenegro in the preservation of stability in the region.

During the day, Prime Minister Mr. Djukanovic had a meeting with the President of the Court of Human Rights Mr. Jean Paul Costa, who noted that Montenegro is responsible partner of the European Court of Human Rights, and that visit to this institution comes at a crucial time for the court and its reform.

The Prime Minister had also discussed with Secretary General of the Council of Europe Mr. Torbjorn Jagland, who welcomed all the achievements of Montenegro, stressing the ratification of numerous conventions and Montenegrin cooperation with the Venice Commission, and emphasizing that Montenegro had been already confirmed as an important partner of the Council of Europe.

Predsjednik Vlade Milo Đukanović razgovarao sa visokim zvaničnicima Savjeta Evrope i Suda za ljudska prava u Strazburu

Predsjednik Vlade Crne Gore Milo Đukanović susreo se, tokom današnjeg zasijedanja Parlamentarne skupštine Savjeta Evrope, sa više visokih zvaničnika Savjeta Evrope i Suda za ljudska prava u Strazburu.

U razgovoru sa predsjednikom Parlamentarne skupštine Savjeta Evrope Mevlutom Čavašogluom, premijer Đukanović je istakao da današnji susret predstavlja nastavak dijaloga započetog u Podgorici.

Gospodin Čavušoglu je naglasio da je Crna Gora zadivljujućom dinamikom potpisala i ratifikovala konvencije Savjeta Evrope, te da u tome vidi političku volju i odlučnost zemlje da primijeni reforme na putu ka EU. Posebno je istakao ulogu Crne Gore u očuvanju stabilnosti u regionu.

Tokom dana, premijer Đukanović je imao susret i sa predsjednikom Suda za ljudska prava Žan Polom Kostom, koji je konstatovao da je Crna Gora odgovoran partner Evropskog suda za ljudska prava, te da posjeta toj instituciji dolazi u ključnom trenutku za sud i njegovu refomu.

Predsjednik Vlade je razgovorao i sa generalnim sekretarom Savjeta Evrope Torbjornom Jaglandom, koji je pozdravio sva dostignuća Crne Gore, ističući pri tome ratifikaciju brojnih konvencija i saradnju Crne Gore sa Venecijanskom komisijom, uz naglasak da se Crna Gora već potvrdila kao veoma važan partner Savjeta Evrope.

Notice: Signed Agreement on Cooperation between Montenegro and Slovenia in the field of intellectual property

The delegation of the Intellectual Property Office of Montenegro, from 14 to 17 June 2010, was in a working visit to Slovenian Intellectual Property Office, and in that occasion was concluded a bilateral agreement on cooperation.

The aim of the agreement is to establish even closer cooperation, especially in the promotion and respect of intellectual property. These documents include the exchange of information on intellectual property, exchange of experiences related to EU accession, exchange and training of staff, including specialized training programs, joint activities whose aim is raising general awareness of intellectual property (lectures, courses, seminars, conferences, and exhibitions), etc.

The Intellectual Property Office will continue to strengthen bilateral and regional cooperation on the issue of intellectual property rights and thus contribute to strengthening the international position and credibility of Montenegro.

Saopštenje: Potpisan Ugovor o saradnji između Crne Gore i Slovenije u oblasti intelektualne svojine

Delegacija Zavoda za intelektualnu svojinu Crne Gore je od 14. do 17. juna 2010. godine boravila u radnoj posjeti slovenačkom Uradu za intelektualno lastnino, i tom prilikom je zaključen bilateralni ugovor o saradnji.

Cilj ugovora je uspostavljanje još bliže saradnje, posebno u promociji i poštovanju intelektualne svojine. Ovi dokumenti uključuju razmjenu informacija o intelektualnoj svojini, razmjenu iskustava u vezi s pristupanjem EU; razmjenu i obuku osoblja, uključujući obuku kroz specijalističke programe; zajedničke aktivnosti koje za cilj imaju podizanje opšte svijesti o intelektualnoj svojini (predavanja, tečajevi, seminari, konferencije, izložbe), itd.

Zavod za intelektualnu svojinu će nastaviti s jačanjem bilateralne i regionalne saradnje po pitanju intelektualne svojine i na taj način dati doprinos jačanju međunarodnog položaja i kredibiliteta Crne Gore.
